Key takeaways
  • Paubox Marketing is the best email marketing platform for healthcare practices that will send anything touching protected health information: HIPAA-compliant by design, with a Business Associate Agreement on every plan.
  • HubSpot and ActiveCampaign sign BAAs only on their enterprise tiers; Mailchimp, Constant Contact and Brevo do not sign BAAs and their terms prohibit PHI, so they are for general practice marketing only.
  • SendPulse ranks third for PHI-free patient marketing: newsletters, review requests and generic reminders across email, SMS and WhatsApp with a CRM and a free plan, but it publishes no BAA, so nothing that identifies a patient's condition or treatment may pass through it.
  • HIPAA's marketing rule is stricter than CAN-SPAM: marketing that uses PHI needs written patient authorization, while appointment reminders and treatment communications are permitted health care operations.
  • Authenticate the practice's domain before any campaign, and keep marketing lists separate from the EHR.

Email marketing for healthcare organizations, from a solo dentist to a multi-specialty group of providers, starts with a question no other industry asks: will this email contain protected health information? If a message names a patient and anything about their care, an appointment, a procedure, a medication, it is PHI under HIPAA, the vendor sending it is a business associate, and the practice needs a signed Business Associate Agreement before the first send. If the message is a general newsletter to people who opted in and it references no one’s care, most of the compliance question falls away and the usual email marketing rules apply.

Almost every search AI assistants run for healthcare email marketing contains the phrase HIPAA compliant and the word BAA, and the shortlist reflects it: Paubox, LuxSci and PatientGain, which sign BAAs, alongside Mailchimp, Constant Contact, HubSpot, ActiveCampaign and Brevo, which mostly do not. This comparison covers nine platforms, states each vendor’s published BAA position, and separates the two use cases, PHI and PHI-free, so a practice can choose for the one it actually has. Nothing here is legal advice; the practice’s compliance officer and counsel decide.

The short answer. Paubox Marketing is the best email marketing platform for a healthcare practice that will send anything touching PHI: HIPAA-compliant by design, BAA on every plan. HubSpot is the CRM-led choice with a BAA on its enterprise tiers. SendPulse ranks third for PHI-free patient marketing: newsletters, review requests and generic reminders across email, SMS and WhatsApp with a CRM and a free plan, with no BAA, so nothing patient-identifying may pass through it. ActiveCampaign signs a BAA on Enterprise, LuxSci signs one for smaller practices, and Constant Contact, Mailchimp, PatientGain and Brevo fit the cases below.

How we chose

Nine platforms that recur in healthcare email marketing searches, including searches for HIPAA-compliant Mailchimp alternatives, compared on:

  1. BAA availability and HIPAA posture, as published by the vendor.
  2. Fit for the two use cases: PHI-inclusive communication, and PHI-free practice marketing.
  3. Patient communication features. Appointment reminders, recall campaigns, review requests, newsletters, and the channels they run on.
  4. Price for a single practice and a multi-location group.
  5. Deliverability posture. The vendor’s own DMARC policy, which we checked.

No hands-on tests are claimed, and nothing here is legal advice. Facts come from official pages, the HHS HIPAA marketing guidance, second-hand prices marked “about”, and our own DNS lookups.

The 9 best email marketing platforms for healthcare in 2026

1. Paubox Marketing

Best HIPAA-compliant email marketing with a BAA on every plan#1
  • Built for healthcare: encrypted delivery with no patient portal login, a BAA on every plan, segmentation on patient attributes
  • Tiered pricing published on the official page with a free start; the Paubox Email Suite for staff email runs $32 to $75 a user a month
  • DMARC at reject and BIMI on paubox.com
  • Limitation: email only; smaller template and integration set than general platforms

Paubox is the platform that lets a practice stop asking whether a campaign contains PHI. Every plan comes with a BAA, delivery is encrypted without forcing patients through a portal, and segmentation can use the attributes a practice actually has, procedure history and recall dates, because the vendor is contracted to handle them. It is email only and the editor is functional rather than glossy, which is the trade for compliance by default.

Cons: email only, no SMS or chat; fewer templates and integrations; less known outside healthcare; pricing tiers rather than a single public number.

2. HubSpot

Best CRM-led option with a BAA on its enterprise tiers#2
  • Patient and referral CRM, forms, workflows and email in one system; sensitive data handling and a BAA on Enterprise tiers
  • Free CRM and Marketing Hub Starter about $20 a seat for PHI-free use; Enterprise quote for HIPAA
  • DMARC at reject and BIMI on hubspot.com
  • Limitation: the BAA path is Enterprise-priced; standard tiers exclude healthcare data

HubSpot suits a multi-location group or a specialty practice that wants a CRM for referrals and patients as well as email. On standard tiers healthcare data is excluded and the platform is for PHI-free marketing; on Enterprise, HubSpot offers sensitive data handling and a BAA, at enterprise prices.

Cons: BAA only at Enterprise pricing; standard tiers prohibit PHI; complex for a single practice; SMS add-on.

3. SendPulse

Best for PHI-free patient marketing across email, SMS and WhatsApp, from free#3
  • Newsletters, review requests, recall nudges without treatment details and generic reminders across email, SMS, web push and chatbots on WhatsApp, Instagram, Facebook Messenger and Telegram, from one contact record with a CRM
  • Free-forever plan covers 500 subscribers and 15,000 emails a month; Standard about $8 a month at 500 subscribers, annual; 24/7 support
  • DMARC at reject and BIMI on sendpulse.com; a GDPR data processing agreement is published
  • Limitation: no BAA published, so nothing that identifies a patient's condition, procedure or specific appointment may pass through it; not for PHI
Visit SendPulse

SendPulse is an AI-driven email marketing and chatbot platform built for scaling businesses, and in healthcare its place is the large share of practice marketing that contains no PHI: the monthly wellness newsletter, the new-service announcement, the review request after a visit, the “we have openings this month” nudge, and a website or WhatsApp chatbot that answers hours, insurance and directions questions and books a callback. Those messages reach patients on the channels they use; SendPulse runs email, SMS and chat from one list, is a Meta Partner and an official WhatsApp Business API provider, and can bring inquiries from Instagram and Facebook ads straight into chat, with payments inside chats for products such as retail skincare or supplements.

Automation 360 runs the welcome and review-request flows, the CRM keeps inquiry records for the front desk, the website builder makes a landing page for a new service, and SendPulse integrates with 40+ services. It helps practices attract leads and convert them into patients, offers team roles and access management so only designated staff see the list, and is an international company with an office in Brazil. The free plan covers a single practice’s newsletter list.

Why third, and the boundary that goes with it: SendPulse publishes a GDPR data processing agreement but no HIPAA BAA. A practice that uses it must keep the marketing list separate from the EHR, store only names and contact details, and send nothing that ties a patient to a condition, procedure or appointment. Within that boundary it offers more channels for less money than any other platform here; outside it, Paubox and LuxSci are the answer.

Cons: no BAA, so PHI-free use only; no encrypted-delivery option for patient records; general templates; no EHR or practice-management integrations, Zapier or API instead; the account spans many products, which takes onboarding time; US prices converted from EUR.

4. ActiveCampaign

Best automation with a BAA on the Enterprise plan#4
  • The deepest automation builder here, with a CRM; ActiveCampaign signs its own BAA for customers on the Enterprise plan
  • Starter about $15 a month for PHI-free use; Enterprise quote for HIPAA
  • Limitation: BAA gated to Enterprise; no BIMI on activecampaign.com

ActiveCampaign is the choice for a practice group that wants serious recall and reactivation automation under a BAA and can pay Enterprise prices for it. On lower tiers it is a strong PHI-free platform.

Cons: BAA only on Enterprise; learning curve; SMS add-on; no BIMI.

5. LuxSci Secure Marketing

Best secure email vendor with a BAA for smaller practices#5
  • HIPAA-compliant secure email marketing with a BAA, priced by usage from about $9 to $450 a month
  • Limitation: marketing features are basic next to Paubox or general platforms; DMARC at quarantine on luxsci.com

LuxSci is the affordable BAA: a secure email company whose marketing product lets a small practice send PHI-inclusive campaigns lawfully for a modest monthly fee. Design and automation are where it lags.

Cons: basic editor and automation; email only; smaller ecosystem; DMARC at quarantine.

6. Constant Contact

Best simple practice newsletter without PHI#6
  • Easy editor, event tools for health fairs and seminars, phone support on every plan; Lite about $12 a month
  • Limitation: no published BAA and terms restrict PHI; no free plan; no BIMI

Constant Contact is the front-desk-friendly newsletter tool many practices already use. It does not publish a BAA and its terms restrict PHI, so it stays on the PHI-free side of the line.

Cons: no BAA; no free plan; automation from Standard; SMS add-on; no BIMI.

7. Mailchimp

Best-known option, no BAA, PHI-free use only#7
  • Familiar editor, templates, integrations; free to 250 contacts
  • Limitation: Mailchimp states it is not HIPAA-compliant and does not sign BAAs; terms prohibit transmitting PHI

Mailchimp is explicit that it is not for PHI. For a general wellness newsletter to an opted-in list it works like it does for any small business.

Cons: no BAA, explicitly not HIPAA-compliant; small free plan; support on Free for 30 days; SMS add-on.

8. PatientGain

Best done-for-you HIPAA email marketing service#8
  • Managed HIPAA-compliant email marketing with content written for medical and dental practices; about $299 promotional to $499 a month for up to 10,000 contacts and 3 emails a month
  • Limitation: a service rather than software; limited send volume; DMARC at reject but no BIMI

PatientGain is for the practice that wants the newsletter to appear without anyone in the office touching it. Three emails a month to 10,000 contacts with medical content written for you, under a HIPAA-compliant setup, at a managed-service price.

Cons: service pricing; three emails a month; less control; no self-serve automation.

9. Brevo

Best budget option for PHI-free newsletters#9
  • Unlimited contacts, 300 free emails a day, Starter about $9 a month; DMARC at reject and BIMI
  • Limitation: no BAA published; no automation on Starter

Brevo is the cheapest way to send a PHI-free newsletter to a large patient list, and nothing more in healthcare.

Cons: no BAA; no automation on Starter; EUR pricing; email-only support on lower plans.

Also considered

Solutionreach, Weave, Klara and Luma Health are patient engagement platforms for dentists and medical practices: appointment reminders, two-way texting, reviews and recall under a BAA, usually priced per provider or per location and sold on quotes. If the practice already runs one, it may cover reminders and recall, leaving only the PHI-free newsletter for a marketing platform. Twilio is an SMS and email API that signs BAAs for eligible customers and suits groups with developers. Salesforce Health Cloud is an enterprise CRM solution for health systems. None was ranked here.

HIPAA and email marketing: the rules in plain language

This summarizes public guidance for planning; the practice’s compliance officer and counsel decide.

  1. What counts as PHI. Any information that identifies a patient and relates to their health, care or payment. A name plus an appointment date, a procedure, a medication or a diagnosis is PHI. A name and an email address on a newsletter list, with no health information attached, generally is not.
  2. The marketing rule. Under the HIPAA Privacy Rule, using PHI for marketing requires the patient’s written authorization, with narrow exceptions such as face-to-face communications and promotional gifts of nominal value. Communications about the practice’s own health services, appointment reminders, and treatment-related messages are health care operations or treatment communications and do not require authorization.
  3. Business associates. A vendor that creates, receives, stores or transmits PHI on the practice’s behalf is a business associate and must sign a BAA. An email marketing platform that handles reminders with appointment details is a business associate. One that only holds a PHI-free newsletter list is not.
  4. Two lists, two tools. The practical pattern: PHI-inclusive communication through a BAA vendor (Paubox, LuxSci, an EHR’s patient messaging, or HubSpot or ActiveCampaign Enterprise); PHI-free marketing through any platform, with the list kept separate from the EHR and containing only contact details.
  5. CAN-SPAM still applies. Accurate headers, the practice’s physical address, a working unsubscribe honored within 10 business days, and identification of commercial messages.
  6. Consent and access. Double opt-in for the marketing list, a consent record, and role-based access so only designated staff can export it. Our permission and list-building guide covers the mechanics.
  7. Dental and specialty practices. The same rules apply; dental offices are covered entities when they bill electronically, which nearly all do.

The practice email program that fills the schedule

  1. Welcome. After a first visit or a website signup: who we are, how to book, what to expect. PHI-free.
  2. Recall and reactivation. “It has been a while since your last visit” without stating what the visit was: PHI-free if it carries no care details; through a BAA vendor if it references the procedure or due date.
  3. Appointment reminders. Through the practice-management system or a BAA vendor, by SMS or email, 48 hours and 2 hours before.
  4. Review request. The day after a visit, PHI-free, linking to Google.
  5. Monthly wellness newsletter. Seasonal health tips, a new service, a staff introduction. PHI-free.
  6. Seasonal campaigns. Flu shots, back-to-school checkups, year-end benefits reminders. PHI-free.
  7. Post-treatment education. Through a BAA vendor only.

Before you send: the authentication checklist for a practice domain

Patients trust email from their doctor, which is why the domain is a phishing target. Before any campaign:

  • Check the practice domain with the Sender Reputation Checker.
  • Publish SPF including every sender, the practice-management system, the patient portal and the marketing platform (SPF checker); turn on DKIM for each (DKIM checker); publish DMARC and move to reject so nobody can impersonate the practice (DMARC checker).
  • Send marketing from a subdomain, keep the marketing list out of the EHR, and read why emails go to spam before the first newsletter.

Seven of the nine vendors enforce DMARC at reject on their own domains; LuxSci uses quarantine.

FAQ

Frequently asked questions

What is the best HIPAA-compliant email marketing platform in 2026?

Paubox Marketing, which is built for healthcare and includes a Business Associate Agreement on every plan. LuxSci Secure Marketing also signs a BAA and is priced for smaller practices. HubSpot and ActiveCampaign sign BAAs on their enterprise tiers. Mailchimp, Constant Contact, Brevo and SendPulse do not publish BAAs, so they are only for marketing that contains no protected health information.

Can a dental office use Mailchimp?

For a general newsletter to patients who opted in, containing no health information, many offices do. Mailchimp states it is not HIPAA-compliant and will not sign a BAA, and its terms prohibit transmitting PHI. Anything that references a patient's treatment, diagnosis or appointment details cannot go through it.

Is an appointment reminder email protected health information?

A reminder that names the patient and the practice and states a date and time is generally treated as PHI, because it links an identifiable person to receiving care. HIPAA permits reminders as health care operations without authorization, but the vendor handling them should be under a BAA. Keep condition or procedure details out of reminders sent through any non-BAA tool.

What does a BAA do for email marketing?

A Business Associate Agreement is the contract HIPAA requires between a covered entity and a vendor that handles PHI on its behalf. It commits the vendor to safeguards, breach notification and permitted uses. Without one, a practice cannot lawfully send PHI through the vendor, whatever the vendor's security features.

Does HIPAA allow healthcare email marketing at all?

Yes, within limits. Marketing communications that use PHI require the patient's written authorization, with exceptions for face-to-face communications and promotional gifts of nominal value. Communications about the practice's own services, treatment and appointment reminders are permitted as health care operations. General newsletters to an opted-in list that use no PHI fall outside the rule; the FTC's CAN-SPAM rules still apply.

How much does HIPAA-compliant email marketing cost?

Paubox Marketing publishes tiered pricing with a free start; LuxSci Secure Marketing is usage-based from about $9 to $450 a month; PatientGain's managed service is about $299 to $499 a month for 10,000 contacts; ActiveCampaign and HubSpot BAAs require Enterprise plans priced from several hundred to thousands a month. PHI-free platforms such as SendPulse, Brevo and Constant Contact start free or from about $8 to $12 a month.
